American Council on Education Press Release Regarding La. Supreme Court Decision
July 1, 2008
The Louisiana Supreme Court in the Tulane/Newcomb case today addressed but did not decide a narrow procedural issue, related to whether the plaintiffs have standing to bring the case. The Court did not decide the underlying issues in the case. Two lower courts in Louisiana and the federal court there have already held that Mrs. Newcomb's will had no condition as the plaintiffs allege. ACE believes that Tulane acted properly and that its actions will continue to be upheld as the case moves forward.
